CMS rules for NP supervision of Hyperbaric Oxygen Therapy

The decision by Novitas, which is the Medicare Administrative Contractor (MAC) with multiple contracts with CMS, to decide that the "scope of practice " for NPs in the states of Delaware, New Jersey, Pennsylvania, Maryland and the District of Columbia, does not include the supervision of Hyperbaric Oxygen Therapy, sets a dangerous precedent. This LCD ( Local Coverage Decision) is more restrictive than the NCD ( National Coverage Decision) covering HBOT (Hyperbaric Oxygen Therapy) which is silent on the topic of who can and cannot supervise Hyperbaric Oxygen Therapy. Novitas is the entitiy processing the Medicare Part A and B claims, covering Jurisdiction 12/L, which includes the states of Delaware, New Jersey, Pennsylvania, Maryland, and the District of Columbia and Jurisdiction H, which includes Arkansas, Colorado, Louisiana, Mississippi, New Mexico, Oklahoma and Texas. Novitas has offices located in Pennsylvania, Maryland, Texas, Florida and Wisconsin. Novitas also administers the national Section 1011 contract for CMS.
